Jung Kam gave evidence at the Police Court. were arrested on the 12th July, and the case at the Police Court the 19th and 20th July, 1899. Before they gave their evidence they had no communication with one another - they were kept in separate cells. I gave special instructions to have them placed in separate wards and separate cells. To the best of my belief they had no communication with one another. After being arrested, they each saw their legal advisers, and after that they made separate statements. I
Cheng On and Jang Kam were arrested and held in custody under banishment warrants - under Section 19 of the Gambling Ordinance, 1891 for promoting gambling.
Defendant has been in the Police about 15 years. Character in the Force has been good, and, as far as I know, he has been an efficient officer. I am not aware of any mark against him. At the Police Court I was asked if Rule 73 of the Police Regulations was in force. The Regulations are those of 1892. I read that rule as a rule that every member of the Force was bound to
Carry out instructions. I have not got a copy of the Regulations with me. I told the Magistrate that that rule did not apply to Inspectors. I told the Magistrate that, to the best of my knowledge, there was no regulation relating to gambling so far as Inspectors were concerned. I led the Magistrate to believe that there was nothing to control the discretion of Inspectors except departmental orders. When I gave evidence, the rule of 1889 about Inspectors slipped my memory.
I was asked at the Police Court whether an Inspector was, in matters of gambling, confined to his own Section, and I said "no". There is no order which absolves an Inspector from reporting a gambling house in another Inspector's Section. I was asked if an Inspector was allowed by the Rules of the Force to make a report on another Inspector's district, and I said "no". There is a rule that an Inspector shall not take out a warrant in another Inspector's District or obtain a warrant in another Inspector's district.
